Terms and Conditions Effective Date: 8/12/24 These Terms and Conditions (“Terms”) govern the use of AI Digital Kendra’s WhatsApp Business API platform (“Platform”) and related services. By registering, accessing, or using our Platform, you agree to these Terms. If you do not agree, you must discontinue use immediately. 1. User Responsibilities You agree to use the Platform solely for lawful purposes and in compliance with all applicable laws and regulations. All activities must adhere to Meta’s WhatsApp Business Policies and avoid prohibited content, spam, or abusive messaging. Fraudulent, deceptive, misleading, or harmful marketing practices are strictly prohibited. You are solely responsible for all content and messages sent through your account. 2. Account Registration & Security You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. Any unauthorized access or breach must be reported to AI Digital Kendra immediately. Axiom Zoom is not liable for any loss or damage arising from unauthorized account access caused by your negligence. 3. Payments & Billing All fees must be paid in accordance with the pricing plan agreed upon at the time of subscription. Payments must be made on time; failure to do so may result in suspension or termination of services. All fees are non-refundable except as required by applicable law. 4. Data Protection & Privacy You must obtain explicit consent from your customers before sending messages through the Platform. You are responsible for complying with all applicable data protection and privacy laws in your jurisdiction. Our collection, use, and protection of personal data are governed by our Privacy Policy. 5. Compliance with Meta’s Policies You must comply with all Meta guidelines and terms for WhatsApp Business API usage. Failure to comply may result in immediate suspension or permanent termination of your account. 6. Intellectual Property All content, branding, and technology of the Platform are owned by Axiom Zoom and protected by copyright, trademark, and intellectual property laws. You may not copy, modify, reverse-engineer, or redistribute our software or proprietary content without written permission. 7. Service Availability & Modifications We strive to keep the Platform available at all times but do not guarantee uninterrupted service. We may update, modify, or discontinue any feature at any time without prior notice. 8. Limitation of Liability To the fullest extent permitted by law, Axiom Zoom shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability for any claim shall not exceed the total fees paid by you to AI Digital Kendra in the three (3) months preceding the claim. 9. Termination We reserve the right to suspend or terminate your account if you violate these Terms, Meta’s policies, or applicable laws. You may terminate your account at any time by contacting our support team. 10. Governing Law & Dispute Resolution These Terms shall be governed by and construed in accordance with the laws of [Insert Jurisdiction]. Any disputes shall be resolved through arbitration or courts located in Hyderabad, unless otherwise required by law. 11. Changes to These Terms We may update these Terms from time to time.
